xQc Is Trying To Sue The DMCA
Well well well, look who’s back. In the wake of his ban, controversial streamer and ex-Overwatch pro Felix ‘xQc’ Lengyel has returned to Twitch, much to the delight of his fans and disdain of his haters. His ban was a touchy one, and one that many Twitch users have debated at length, but either way - he’s back to his old tricks, and is suggesting that from here on out, he’ll be back to his daily streams.
Most interesting about his recent stream is the suggestion that he3’s not willing to take the claim he received lying down. In fact, he’s fighting back against it.
xQc Explains His Streaming Ban
Click to enlargeUpon his big return to the platform, xQc explains what exactly happened with his dramatic banning. As it turns out, the ban itself had some strange timings attached to it. “Basically, I was showing the Olympics, and I was doing some react content, right?”, he begins. “And then I get striked. And normally, strikes don’t get you banned, right? But because it’s a Live strike they ban you, so there’s no further damage or whatever. And normally it’s 24 hours, but for some reason, for me, it was a two-day ban.”
Supposedly this ban doesn’t count towards his sum of bans that contributes towards a perma-ban, but his fans have missed him, if only for a few days. And while it’s given the streamer a chance to catch his breath after his packed streaming schedule, he’s fighting back.
xQc Reveals He’s Counter-Striked His DMCA
Click to enlargexQc is not willing to simply take the claim from the Olympics, it would seem, as he’s gearing up to take legal action against the DMCA strike that could have put his channel at risk, and has kept him from making money. “We issued, and we’ll call it, a ‘counter-claim’”, he says. “Which is pretty ballsy! What a counter-claim does is that they strike me, and instead of saying ‘oh, I f**ked up, it’s kinda like saying ‘no, I’m right’.”
xQc is confident that he did nothing wrong in his stream, and is willing to make legal action to prove it. “This is transformative content. This is fair use, and this is not what you guys claim it is.”
The escalation of this situation could quite seriously endanger xQc’s streaming career, but if it doesn’t, it could be regarded as a serious triumph. DMCAs are a big problem on Twitch, and this pushback could bring about some major changes for the platform. Fingers crossed, both for the platform and xQc’s dedicated fans, that this works in the streamer’s favour.
